Pot clinic operator now has Stockton operation shut down

Hours after the San Joaquin County Superior Court issued an injunction that temporarily closed the new marijuana dispensary in downtown Manteca, the Stockton City Council closed the doors Tuesday night on their similar facility on Acacia Avenue.

It was earlier in the day on Tuesday that San Joaquin County Superior Court Judge Lesley Holland issued a temporary restraining order to halt the sale of marijuana from the recently opened dispensary in the 300 block of West Yosemite Avenue.

The security officer’s wooden chair was no longer located in front of the shuttered Manteca dispensary yesterday.

Manager of both the Stockton and Manteca dispensaries, Lynn Smith and his Oakland based attorney Robert  Shantz,  appeared before Judge Holland in Stockton’s Department 13 at 8:15 a.m. They will return on March 24 to argue why they should be allowed to operate their outlet at the Manteca location.

A sign on the front door of the “medical marijuana” outlet lists the operation as a cooperative, however the Manteca Police Department contend it is a dispensary.  Several downtown merchants voiced their displeasure earlier this week at the opening on the Quick & Easy (Q&E) dispensary.

The Stockton City Council turned down Smith’s appeal Tuesday night against the revocation of his business license to operate in the city following its opening last year.

Known as Pathways Family Health Cooperative Counseling, the business opened its doors in November with the city’s approval to sell natural foods and supplements – not including marijuana.

Council members voted unanimously to revoke the license questioning why they hadn’t been told of the intended sales of marijuana.  The Pathways’ attorney reportedly said that because the city code does not mention marijuana, it was not included in the license application.

The attorney said he would have to evaluate the position of his client before knowing what direction the dispensaries might take next.
