Homeless in illegal camping case could face arrest

It’ll be another week before 70-year-old Norman Moore will get to plead his case to San Joaquin County Superior Court Judge Gus C. Barrera II.
Moore, was cited for illegal camping on Sept. 29 and subsequently fined $1,210 as a result of the infraction, told the court that he would be late Friday morning because he had a flat tire – derailing the proceedings for almost two hours before Barrera decided to continue the matter to next week contingent on him actually showing up in court.
If he doesn’t, Barrera indicated that he would issue a warrant for his arrest.
Manteca City Attorney John Brinton represented the city Friday morning, and indicated that the city’s initial offer to Moore to settle – 20 hours of community service, one year of summary probation and the contingency that he not commit any crimes or do anything similar during that period – still stand,, and said that Attorney Don Lupal, who will take over for Brinton on Tuesday, will once again extend the opportunity to settle the case.
Moore initially told Barrera when he appeared in court last month that he wanted to take the case to trial because there were “extenuating circumstances” that he felt would lead to a dismissal.
When he arrives back in court on Dec. 12, he will have the added benefit of court-appointed counsel.
The fine, which Moore has indicated he had an issue with, didn’t come from the City of Manteca, but was levied by the San Joaquin County Superior Court as a result of the infraction. Moore was cited for camping on Pacific Road off of West Yosemite Avenue, across the street from Save Mart.
Moore has claimed that he’s been living on the street since August, and was twice notified to vacate his camp site – which is on private property – before the citation was issued. According to Brinton, a phone call placed to the police department prompted the response by officers.
Moore is scheduled to return to Barrera’s courtroom – Department M2 at the Manteca courthouse on Center Street – at 8:30 a.m. on Dec. 12.
