Two Hells Angels bikers have been arrested for the August 2011 murder of 26-year-old Daniel Martinez of Lathrop in an unincorporated area east of Manteca off East Highway 120 east of Austin Road.

San Joaquin County Sheriff’s detectives made the arrests on Wednesday after working closely with the San Joaquin County District Attorney’s Office to secure murder warrants for Brandon James Gann, 31, and David John Splan, 42.

On Aug. 15, 2011, around 6:30 p.m. Sheriff’s deputies responded to a call of shots fired in the 17000 block of Ideal Parkway off East Highway 120.  When deputies arrived they found Martinez unresponsive and bleeding from an apparent gunshot wound to the upper body.   He was pronounced dead at the scene by paramedics.

A second victim – a 30-year-old man – was found a short distance away also suffering from a gunshot and having difficulty breathing.  He was transported to an area hospital where he underwent surgery and ultimately survived.

Witnesses told deputies at the scene that the two men had been sitting or standing outside a business near two motorcycles.  A white compact SUV, reportedly occupied by two white males, sped through the parking lot of the business ramming one of the motorcycles.

Both men were said to have gotten out of the SUV and began beating both of their victims.  At one point, the passenger of the vehicle retrieved a handgun from the rear of the SUV and started firing at the victims.  After the men fell to the ground, the suspects both got back into their vehicle and fled the area at a high rate of speed back onto Highway 120.

Martinez had attended Manteca schools growing up in the community.

The suspects are scheduled to appear in the San Joaquin County Superior Court in Stockton; Gann, today, at 1:30 p.m., and Splan on Friday, Jan. 11, at 8:30 a.m.  The two are being held in the San Joaquin County Jail in French Camp without bail.
