Arraignment delayed in rural Manteca murder

An alleged Hell’s Angel accused of participating in the fatal shooting of a 26-year-old Daniel Martinez of Lathrop in a business park east of Manteca had his arraignment continued for two weeks during a San Joaquin County Superior Court appearance Friday.

David Splan, 42, of Tracy is  charged with premeditated murder, attempted murder, being armed with a firearm during a felony, use of a firearm in commission of a felony, intentional and personal discharge of a firearm and street terrorism, Also being charged with the murder is Brandon Gann, 31, of Stockton,. Gann is also reportedly a member of the motorcycle gang.
Martinez was shot to death Aug. 15, 2011 on the 17000 block of Ideal Parkway off of East Highway 120 east of Austin Road. A 30-year-old man who was with Martinez was also shot but survived after surgery.

An unidentified 30-year-old man who was with Martinez was also found with one gunshot wound.
Both victims were outside of a business near two motorcycles when a white SUV rammed into the victims’ parked motorcycle. Two men out of the SUV and beat the victims. At one point the suspects allegedly grabbed a gun from the SUV and shot the two.

The defendants each are being held on $5 million bail.
