MAN DIES IN MODESTO ARSON FIRE: MODESTO  - A man pulled from a house fire in Modesto Friday morning has died, according to the Modesto Fire Department.

Firefighters were sent to a report of smoke from a home on the 1700 block of Judy Court at 10:41 a.m., Battalion Chief Hugo Patino said. He said crews found the flames contained to one bedroom and heavy smoke in the rest of the house.

Firefighters and paramedics performed life-saving measures on the victim who was transported to Doctors Medical Center. However, the man did not survive.

When crews investigated the scene, they found evidence of a burglary and arson, Modesto police Sgt. Rick Applegate said.

Patino pegged the cost of the damage to the house and its contents at $75,000.

The identity of man is being held until his family is notified.

 

LAWYER SUING OVER ADA VIOLATIONS SUED FOR HOIS OWN ADA VIOLATION: LODI- An attorney who sued businesses for not meeting ADA requirements is now facing his own lawsuit, for not meeting those same requirements.

Brothers James and Robert McCarty own Town & Country Liquors in Lockeford. Their business, along with about a dozen others were sent letters stating they did not meet ADA code and they had 60 days to fix the problems.

In the resulting lawsuit, the woman and her attorney Russel Humphrey, claimed the businesses did not have van accessible space or signage.

The McCarty brothers have filed a lawsuit this week against Humphrey and his office building in Lodi claiming they had trouble visiting him to discuss the legal action they faced.

They say there were not enough disabled parking spots, and the elevator was either hidden or not working when they stopped by Humphrey’s Lodi office. Their suit points out the irony of Humphrey’s profession and the violations reportedly found at his place of business.

The McCarty brothers want the case to go before a jury.
