VETERAN RUNNER DIES DURING MT. DIABLO FOOTRACE: MARTINEZ  (AP) — A veteran long-distance runner competing in a 50-kilometer footrace on Mount Diablo died during the competition.

The San Francisco Chronicle reports that 63-year-old Rene Brunet died Sunday during the 31-mile race.

Brunet was a veteran ultra-marathoner, which describes races longer than the 26.2-mile marathon, and had already run seven of the long races this year before Sunday's event.

His friend John Brooks say Brunet was on pace to finish in the allotted time, but that he disappeared between the last checkpoint and the finish line.

His body was found down an embankment about three miles from the end of the race.

SF  COP SAYS HE WAS RACIALLY PROFILED DURING STOP: SAN FRANCISCO (AP) — A lawyer for a San Francisco police officer says his black client was the victim of racial profiling when he was arrested last week.

Attorney John Burris said Tuesday that when three white San Francisco Police officers pulled over fellow officer Lorezno Adamson they asked whether he was on probation and parole. Adamson said he replied by saying he should have instead been asked for his driver's license and registration. Adamson said he was choked, thrown to the ground and arrested after telling the trio that he was an officer and that he was armed.

Adamson was cited Thursday and later released from custody for resisting arrest and license plate and tinted window violations. The 15-year veteran was off-duty at the time.

The incident remains under investigation.

PROSECUTOR: 2 MEN ON TRIAL HELPED OTHERS RAPE TEEN:  MARTINEZ  (AP) — A prosecutor says two men charged in the gang rape of a 16-year-old girl outside a Northern California high school's homecoming dance also helped others participate in the horrific assault.

The Contra Costa County prosecutor told jurors Tuesday that 22-year-old Richmond resident Jose Montano and 20-year-old Marcelles Peter of Pinole were part of a larger group of men who punched, dragged, robbed and urinated on the heavily intoxicated teen two years ago outside Richmond High School.

Montano's attorney Jane Elliot countered during the second day of trial that there are too many conflicting statements about her client's involvement to convict him. Elliot acknowledged Montano's DNA was on a condom wrapper and a can of alcohol at the scene but maintained it was not found on the girl.

SF SUES STARTUP OVER AIRPORT RULES: SAN FRANCISCO (AP) — The City of San Francisco has filed a lawsuit accusing a startup that allows travelers to rent out their cars instead of paying for airport parking of flouting San Francisco International Airport rules.

FlightCar, Inc. has refused to pay the airport 10 percent of its profits and $25 per rental like rental car companies.

FlightCar says it is not a rental car company, but a mix between ride sharing and off-airport parking. It says it does not operate on airport property and is accordingly out of reach of airport fees.

But San Francisco attorneys say SFO is entitled to collect fees from rental car companies that mainly serve its travelers even if they are not on airport property.

They also accuse FlightCar of violating other rules.

BIDS ON LUNCH WITH BUFFETT ALREADY TOP $750,000: SAN FRANCISCO  (AP) — The price of a private lunch with billionaire Warren Buffett has already topped $750,000, and the online auction to raise money for a California homeless charity continues all week.

The eBay auction began Sunday with a $25,000 opening price. By Tuesday afternoon, eight bidders drove the price up to $750,100.

That's an impressive price for lunch, but last year's winner paid $3,456,789. The Glide Foundation, which provides social services to the poor and homeless in San Francisco, counts on the auction proceeds as part of its $17 million annual budget.

Buffett's advice is sought because of his investing success and his decision to give most of his fortune to charity.

Bidding continues until 9:30 p.m. Central Friday, and prices usually soar near the end of the event.
