MODESTO . (AP) — The city of Modesto is paying $150,000 to settle a lawsuit by a suspected peeping Tom who was shot three times by an off-duty detective.

Joshua Mordoff was shot in May 2010 when a father discovered him in his backyard near his teenage daughter’s window.

Officials say as the father and Mordoff struggled, another family member called off-duty detective Jim Rokaitis, who lived nearby. Rokaitis said he fired after Mordoff ignored his orders to get on the ground and stepped toward him.

Mordoff spent a week in the hospital after the shooting.

Court records show Mordoff pleaded no contest to the misdemeanors of disorderly conduct and peeking in the window of an occupied building.

Mordoff says he has turned his life around and hopes he won’t face any retaliation.
