Sexual battery charge for Ripon High custodian

RIPON — Ripon High School custodian Carlos O. Gutierrez, 33, was charged with sexual battery with restraint against a juvenile student in the school gym Friday afternoon.

Ripon Police First Sergeant Steven Merchant said the custodian was working at the school at the time of the incident, adding that the student was not physically harmed.

Gutierrez was booked into San Joaquin County Jail in French Camp about 4:30 p.m. and is being held in lieu of $125,000 bail reflecting one felony and one misdemeanor charge.   His court appearance is scheduled for Tuesday at 1:25 p.m. in the Manteca Branch of the San Joaquin County Jail.

Merchant said the incident was brought to the attention of school officials who quickly notified the on-duty school resource officer assigned to the high school.  He added that the Modesto man voluntarily responded to the police department for questioning and was taken into custody.

Merchant lauded the close cooperation between the victim, the school and the police as being the key to the quick arrest in the case.
