MISSING COLO. MAN FOUND DEAD IN THEATER RESTROOM: FORT COLLINS, Colo. (AP) — A Colorado man who was missing for five days was found dead in a locked movie theater restroom after workers noticed an odor and forced their way in, authorities said.

Police had searched the area around the Fort Collins theater after the family of 66-year-old George DeGrazio reported him missing on Jan. 9 and his vehicle was found nearby.

DeGrazio died of a heart attack, Deputy Coroner James MacNaughton told KMGH-TV of Denver.

The man's son, Dylan DeGrazio, told the station that he was upset that theater employees didn't find his father's body earlier.

"If I had the police department saying somebody disappeared in this area and we're trying to locate him, I would be searching every nook and cranny of my establishment," he said. "But that didn't happen."

A spokesman for Cinemark didn't immediately return a message left by The Associated Press. In a statement, the company said it was working with authorities and couldn't comment on an ongoing investigation.

"Our thoughts and prayers go out to the DeGrazio family during this difficult period as they mourn the loss of a loved family member," the company said in the statement.

FUGITIVE'S SUIT AGAINST KANSAS HOSTAGES DISMISSED: TOPEKA, Kan. (AP) — A judge has dismissed a lawsuit filed by a Colorado man who held a Kansas couple hostage then sued them for breach of contract for turning him in.

Jesse Dimmick of Denver contended he had a legally binding oral contract with Jared and Lindsay Rowley that they'd hide him from police in return for money.

Dimmick was a fugitive facing a murder charge when he burst into the Rowleys' home in September 2009 and confronted them at knifepoint. The Rowleys escaped when he fell asleep.

Dimmick was later convicted of kidnapping and other charges and the Rowleys sued him for more than $75,000 in damages. Dimmick counter-sued, seeking $160,000 for hospital bills and $75,000 for pain and suffering.

WIS. DEMOCRATS STILL SEARCHING FOR WALKER OPPONENT: MADISON, Wis. (AP) — Supporters of a push to oust Wisconsin Gov. Scott Walker from office are prepared to declare victory in their effort to force the Republican into a recall election. But a problem looms for Democrats: They still don't know who would run against him.

Recall organizers say they have gathered far more than the 540,208 signatures required to force the election against both Walker and GOP Lt. Gov. Rebecca Kleefisch, and will submit their petitions Tuesday.

Walker has meanwhile dominated the state's airwaves with ads defending his agenda, including the law enacted last year that ended nearly all collective bargaining rights for most public workers and spurred the recall effort in the first place.

He's also crisscrossed the country raising millions of dollars, taking full advantage of both the conservative rock star persona built as he put Wisconsin at the center of the national labor rights debate and a quirk in state law allowing those targeted for recall to ignore normal contribution limits until an election date is set.

Walker reported in mid-December that he'd already raised $5.1 million, with about half of that coming from out of state. He received $250,000 alone from Bob Perry, the Texas conservative who was one of the main financial backers behind the Swift Boat Veterans ads that attacked Sen. John Kerry during the 2004 presidential campaign

MOUNT RAINIER PARK OFFICIAL: SNOWSHOER FOUND ALIVE: SEATTLE (AP) — A 66-year-old snowshoer who had been missing on Mount Rainier since Saturday was found alive Monday afternoon by a team of three rescuers, a national park spokeswoman said.

Yong Chun Kim, of Tacoma, Wash., was alert and conscious, and was cold but otherwise stable, park spokeswoman Lee Taylor said. Weather conditions prevented a helicopter from landing in the area, and rescuers were bringing in a Sno-Cat snow vehicle to carry him out — hopefully by Monday evening, she said.

Kim, who has been snowshoeing for a decade, was well equipped for a day of snowshoeing but didn't have overnight gear.

Temperatures dropped into the teens and eight inches of new snow fell in some areas since Saturday. With winds whipping on the mountain, some areas saw as much as 30 inches of snow. More snow is expected over the next few days.

BANK FORECLOSING ON O.J. SIMPSON'S FLORIDA HOUSE: MIAMI (AP) — Like tens of thousands of other Florida homeowners, imprisoned former football star O.J. Simpson is in danger of losing his house to foreclosure.

Miami-Dade Circuit Court records show that JPMorgan Chase filed for foreclosure in September on the four-bedroom, four-bath house south of downtown Miami. Simpson's attorney has since filed a motion to dismiss the case, but there has been no further action since November.

Simpson bought the 4,233-square-foot house in 2000 for $575,000, property records show. Its current assessed value is $478,401, with property taxes of about $9,000. The 2011 taxes were paid in December.

The 64-year-old former football star and actor is serving a nine-to-33-year prison sentence stemming from a 2007 armed confrontation with sports memorabilia dealers in a Las Vegas casino hotel room. Simpson was convicted of kidnapping, armed robbery and other charges. He is appealing the conviction.

Simpson was acquitted in 1995 in the Los Angeles slayings of his ex-wife, Nicole Brown Simpson, and her friend, Ronald Goldman. A civil jury in California later ordered Simpson to pay $33.5 million for Goldman's wrongful death. The attorney for Goldman's father, Fred Goldman, said Monday the bankruptcy case played directly into the Simpson foreclosure.

KID ROCK APOLOGIZES AFTER CIGAR COMPLAINT: WARREN, Mich. (AP) — Kid Rock has apologized after a man complained that the musician smoked a cigar at a nonsmoking venue in the Detroit area.

Randy Snell says Kid Rock lit the cigar while attending country singer Travis Tritt's show Friday at Andiamo Celebrity Showroom in Warren.

Spokesman Nick Stern told The Detroit News that Kid Rock offered his "most sincere apologies" to patrons he may have offended. He said he had been drinking alcohol.

Fifty-eight-year-old Randy Snell, of Trenton, has asthma and says he plans to file a health department complaint. Michigan law prohibits smoking at workplaces including bars and restaurants.

Kid Rock was born Robert Ritchie. He grew up in and lives in suburban Detroit.
