Manteca Councilman Dave Breitenbucher is not being charged by the San Joaquin County District Attorney for the Jan. 23 shooting if his 31 year-old stepson Landon White.

In a press release Saturday, it was announced White is being charged for assault with the intent to commit great bodily injury.

The decision to charge White came after a thorough joint investigation conducted by the San Joaquin County District Attorney's Office Bureau of Investigations and the Manteca Police Department, the San Joaquin County District Attorney’s Office.

Additionally, after careful review, the San Joaquin County District Attorney’s Office has decided not to file charges against Councilmember David Breitenbucher.

Following San Joaquin County protocols, and based on a comprehensive investigation, the Chief Deputy District Attorney has determined that the charge brought against White is appropriate.

The shooting took place in Breitenbucher’s  home. White was not a resident of the home.

Breitenbucher had  told Manteca Police his stepson attacked him and threatened to kill him in a confrontation inside his home.

Police said Breitenbucher fired a personal firearm.

White, a 2013 Manteca High graduate, sustained a gunshot wound to the abdomen.

Breitenbucher suffered a laceration to his head.

The councilman called 9-1-1 to report the shooting.

Breitenbucher is a retired Manteca Fire captain.

He is currently in his sixth year serving as a council member for Area 3.

Breitenbucher for years coached the Manteca High swimming team and then the Sierra High water polo team.

The council devotes a good portion of his free time volunteering with the outreach effort to try and get the homeless off of Manteca streets.
