Student attacked by guard sues district

OAKLAND (AP) — An Oakland High School student who was dumped out of his wheelchair by a campus security guard has filed a lawsuit against the school district.

The San Francisco Chronicle reports Friday that Francisco Martinez, 18, says in his suit that he was wrongfully detained when campus guard Marchell Mitchell cuffed and punched him in a May 2014 incident caught on surveillance camera. Martinez has cerebral palsy and uses a wheelchair.

Mitchell was encouraging students to get to class when he got into an altercation with Martinez. Mitchell was fired from his job.

The suit seeks unspecified damages. Among named defendants are the Oakland Unified School District, Oakland schools police, Mitchell, and former interim Superintendent Gary Yee.
