SAN JOSE THEATER EVACUATED DURING BATMAN SCREENING: SAN JOSE (AP) — San Jose police say a movie theater was evacuated when someone threw a suspicious package into a screening of the new Batman film.
The San Jose Mercury News reports dozens of moviegoers watching the "Dark Knight Rises" fled the Eastridge Mall AMC theater Monday night.
Officials say witnesses told police that someone opened the theater door, yelled an expletive and tossed a box into the center aisle, saying it was a bomb.
Police say about 150 people watching other movies were also evacuated from the building.
Authorities summoned a bomb squad, which determined the box was harmless. Police haven't identified a suspect and an investigation is ongoing.
The incident happened just days after a gunman opened fire in a Colorado movie theater, killing 12 and injuring dozens of others.
2ND SUSPECT IN SF TRIPLE MURDER PLEADS NOT GUILTY: SAN FRANCISCO (AP) — A second suspect accused of fatally shooting a San Francisco father and his two sons has pleaded not guilty to triple murder charges.
Wilfredo "Flaco" Reyes entered his plea Tuesday in San Francisco Superior Court more than two weeks after he was arrested in North Carolina on suspicion of murdering Anthony Bologna and his sons, Michael and Matthew in June 2008.
The 31-year-old Reyes is charged with three counts of murder with special allegations, including participation in a criminal street gang. He's due back in court on Aug. 22.
Prosecutors say Reyes and Edwin Ramos, alleged members of the MS-13 gang, opened fire on a car carrying the Bolognas after mistaking one as a rival gang member.
MAN, WOMAN SHOT, INJURED IN I-80 SHOOTING: HERCULES (AP) — A man and a woman are recovering after they were shot while riding on a freeway in Northern California.
Police said someone opened fire into the driver's side of a white Pontiac heading eastbound on Interstate 80 in Hercules late Tuesday night.
Hercules Police officer Connie Van Putten said the car's 24-year-old male driver was shot and spun his vehicle out onto the shoulder of the highway. His 24-year-old female passenger also was shot, suffered a broken arm and had surgery on Wednesday.
Van Putten says that another man and four children, ranging in ages from 3- to 12-years-old, were also inside the car but were not harmed.
Police say they do not have a suspect or motive for the shooting which remains under investigation.
JUDGE RULES WILLIAM AYRES COMPETENT TO STAND TRIAL: REDWOOD CITY (AP) — The case involving a once-prominent Northern California child psychologist accused of molesting former patients is taking an unexpected turn.
A judge has determined that William Ayres is now competent to stand trial.
The San Mateo County Times reports that a judge made the ruling during a hearing Wednesday, ordering William Ayres be returned from Napa State Hospital to Redwood City for a bail hearing on August 3.
The ruling comes after a report from doctors at the mental health facility said that the 80-year-old doctor is well enough to defend himself in the case.
Ayres was committed to the institution after his 2009 trial in San Mateo County on nine counts of lewd and lascivious conduct with a minor under 14 ended with a hung jury.
PROBATION OFFICER HURT WHEN GUN ACCIDENTALLY FIRES: SCOTTS VALLEY (AP) — A Northern California probation officer has been hurt when his gun accidentally fired during an investigation.
The Santa Clara County probation officer, who has not been identified, was treated at a local hospital for an undisclosed injury.
The San Jose Mercury News says the probation officer was with San Jose police during a Tuesday night arrest on Highway 17 in the Scotts Valley area.
The probation officer wasn't part of the arrest of the 22-year-old suspect wanted on a $1 million felony warrant for firearms violations.
Angel Solorzano was driving on northbound Highway 17, south of the summit, when he was arrested.
DA WON'T PURSUE PERJURY CASE AGAINST SF MAYOR: SAN FRANCISCO (AP) — Prosecutors won't investigate allegations that San Francisco Mayor Ed Lee committed perjury in his bid to oust Sheriff Ross Mirkarimi.
District Attorney's office spokeswoman Stephanie Ong Stillman said Tuesday that there's no basis for opening a criminal investigation.
The San Francisco Chronicle (http://bit.ly/NRKfWG) says Mirkarimi's lawyers suspect the mayor twice lied under oath during questioning last month before the city's Ethics Commission.
The mayor says he told the truth and the allegations are outrageous.
Mikarimi attorney's asked the commission to subpoena four people to examine the allegations, but the request was denied.
Commissioners say the mayor's statements were irrelevant to whether Mirkarimi committed official misconduct in pleading guilty to misdemeanor false imprisonment in a domestic violence incident.
The Board of Supervisors will decide if the suspended sheriff keeps his job.
1 DEAD, 2 INJURED IN SAN FRANCISCO APARTMENT FIRE: SAN FRANCISCO (AP) — Officials say one person has died and two others were hurt in an apartment building fire in San Francisco's Western Addition neighborhood.
Fire Department spokeswoman Mindy Talmadge says after the blaze began on the second floor of the three-story building around 10 a.m. Wednesday, it quickly spread to the top floor of the building.
Talmadge says the person who died was in an apartment on the second floor. The name of the person has not been released, but neighbors said he was an elderly man.
Two other residents of the building, two men who lived on the third floor, were treated at the scene for smoke inhalation.
Talmadge says firefighters brought the fire under control in about 30 minutes, but the building received heavy structural and water damage. It is not known how many residents are displaced.
The cause of the fire has not been determined.
