City overcharged restaurant $15,151 over 9 years for water

The City of Manteca has been overcharging Chez Shari restaurant at the municipal golf clubhouse for water use to the tune of $15,151.20 over nine years.

The overcharge was the result of the city charging owner Frank Guinta Sr. not just for domestic water used at his snack bar on the ground floor and second floor restaurant but landscaping outside the clubhouse as well.

The City Council on Tuesday will consider a remedy that makes it clear Guinta does not have to pay for water to irrigate the city’s landscaping outside the clubhouse. At the same time, they are being asked to approve an agreement that would credit the overpayment back to Guinta by reducing his rent by 25 percent for the next 22 months.

The city recently cross-connected the irrigation system for the landscaping with the irrigation on the golf course that receives its water from irrigation well. As a result, the city will not incur any additional costs for irrigating the clubhouse landscaping.
